Primary Purpose of Organizational Unit:   This position performs legal work advising the Haywood County Health & Human Services Agency concerning legal matters, and representing the Agency in court when necessary.  This employee serves in a leadership capacity on committees.

Primary Purpose of the Position:    The employee in this position performs a variety of professional legal work for the Health and Human Services Agency which includes the following divisions:  Social Work, Economic Services, and Public Health.  The work involves preparing cases associated with the Health & Human Services Agency for trial and presenting these cases in court.  Additional responsibilities include drafting court orders, preparing legal documents, participating in required pretrial conferences, consultation and training of staff.  Workflow for this position will be directed by the Agency Attorney II.  At the Attorney I level, this position will provide legal support in areas of limited scope and complexity and/or support higher level attorney in specific aspects of casework.

The position requires considerable tact, courtesy and firmness must be exercised in frequent contacts with a wide variety of individuals.  This employee is afforded considerable latitude for independent action and discretion in the performance of assigned work, though consultation is available when necessary.  Assignments are carried through to completion under the general direction of the Agency Director and work is reviewed through conferences.

General Statute 108A-18

(a)  The special county attorney shall have the following duties and responsibilities:

  1. To serve as legal advisor to the Agency Director, the Health & Human Services Board, and the Board of County Commissioners on Health and Human Service matters
  2. To represent the county, the plaintiff, or under oblige in all proceedings brought under Chapter 52A, the Uniform Reciprocal Enforcement of Support Act and to exercise continuous supervision of compliance with any order entered in any proceeding under that act;
  3. To represent the Haywood County Health & Human Services Board in appeal proceedings and in any litigation relating to appeals;
  4. To assist the district attorney with the preparation and prosecution of criminal cases under Article 40 of Chapter 14, entitled “Protection of the Family”;
  5. To assist the district attorney with the preparation and prosecution of proceedings authorized by Chapter 49, entitled “Bastardy”;
  6. To perform such other duties as may be assigned to him/her by the Board of County Commissioners, the Haywood County Health & Human Services Board, or the Agency Director.

(b) In performing any of the duties and responsibilities set out in this section, the special county attorney is authorized to call upon any director of social services or the Department of Health and Human Services for any information as he may require to perform his duties, and such director and Department are directed to assist him/her in performing such duties.  (1959,c 1124, ss 2 2, #; 1969, c 546, s, 1; 1973, c 47, s 2; c 476, s 138; 1981, c 275, s 1; 1997-443, s 11A.118(a).

Knowledge, Skills, and Abilities – Knowledge of case, statutory, regulatory, and common law. Knowledge of judicial and quasi-judicial procedures regarding the rules of evidence. Knowledge of the rules of evidence. Ability to perform legal research in accordance with initial guidance as to methods of approach, source materials available, and policy and precedent of the office. Ability to understand and interpret constitutional provisions, statutes, administrative regulations, and precedents. Ability to analyze facts, evidence, and legal instruments. Ability to express conclusions and arguments clearly and logically in oral and written form. Ability to maintain effective working relationships.

Minimum Training and Experience Requirements – Graduation from an accredited school of law.

Necessary Special Qualification – License to practice law in the State of North Carolina.

Additional Requirements: Applicants must submit official college transcripts (if applicable).  Applicants must have NC Driver’s License and access to a vehicle.  The applicant must have a clean driving record with no more than three (3) points showing on current DMV record.

Applicants should request a continuation sheet to record additional work experience on the application. Applications should include at least ten (10) years of work experience on the application (if applicable).  No additional information will be solicited or considered by this office; therefore individuals who submit incomplete applications may not receive full credit for their education, training and experience.  Applicants will not automatically be given credit based on their position or title.
