Nominations to fill a vacancy for the Office of Public Defender of Defender District 28 will be made at a meeting of the Buncombe County Bar on August 31, 2020, for a term of office beginning the first day of October, 2020. Notice is hereby given, pursuant to N.C.G.S. 7A-498.7 and Article VII of the Bylaws of the Buncombe County Bar, of a special meeting of the Buncombe County Bar, for the purpose of determining nominations to submit to the Senior Resident Superior Court Judge in District 28 to fill this vacancy.


Voting shall be limited to members of the Buncombe County Bar resident in the defender district who are licensed to practice law in North Carolina and who are in attendance at the online meeting hosted via Zoom. The Zoom meeting invitation will be sent to the email address on file with the North Carolina State Bar prior to the meeting.

Before nominations begin, the Bar shall decide by majority vote whether two or three persons shall be nominated.  Nominations may be received from the floor from any member authorized to vote. Voting shall be by written ballot via the Zoom polling software, and each voting member shall be entitled to vote for one candidate.  Ballots marked for more than one candidate will not be counted.  The two or three candidates, as previously determined, receiving the highest number of votes cast shall be the nominees.

The votes shall be counted under the direction of the presiding officer and the results announced at the meeting.  The Senior Resident Superior Court Judge shall appoint the Public Defender from among the District Bar nominees and one name submitted by the Director of the Administrative Office of the Courts after consultation with the Director of the Office of Indigent Defense Services.
