In the first hour, the 2018 revisions to the Federal Rules of Civil Procedure and the Federal Rules of Criminal Procedure will be discussed, along with the impact those revisions have had on the Local Rules and practices of the Western District of North Carolina. In addition, Judge Keesler will lead an in-depth discussion on sealed filings and appropriate motions practice. (One-hour general)

In the second hour, Judges Reidinger, Cogburn and Keesler will lead a panel discussion on best federal court practices, with an emphasis on in-court advocacy and ethical practices. In particular, the Judges will address: new Local Rule 83.2 concerning attorney discipline in the Western District; the recent revision to Rule 12.4 of the Federal Rules of Criminal Procedure and its impact on recusal under Canon 3(C)(1)(c); and the ethical implications of Revised Criminal Rule 49(b)(4), which does not bring over the “representations” being made to the court by counsel in a signed pleading under Federal Civil Rule 11. In addition, career law clerks will participate in the panel discussion concerning motions practice and acceptable communications with chambers in light of Rule 3.5(a)(3) of the Rules of Professional Responsibility.
